Although the legal framework has existed for 25 years, the Danish Act on Employees’ Rights on Transfer of Undertakings and case law from both national courts and the European Court of Justice continue to cause considerable uncertainty and therefore also many strategic considerations in relation to both collective agreements and individual employment contracts.
